Terms of Use

These Terms of Use (the “Terms”) are a binding agreement between you and CodeNomad, the provider of the Dolio mobile app and the website at https://dolio.org (together, the “Service”). By creating an account or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old and able to form a binding contract under the laws of your country to use the Service. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

2. Your account

You must provide accurate information when registering and keep it up to date. You are responsible for safeguarding your sign-in credentials and for everything that happens under your account. Notify us at support@dolio.org if you suspect unauthorised access.

3. Licence to use the Service

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Dolio app on devices you own or control and to access the Service for your own non-commercial expense-tracking use.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Harass, threaten, defame, or infringe the rights of any person or group, including through the names you give to groups, members, or expenses.
  • Upload content that is illegal, sexually explicit, or that you do not have the right to share.
  • Attempt to disrupt, overload, reverse-engineer, decompile, scrape, or bypass any access control on the Service, except where the law expressly permits it.
  • Resell, sublicense, or commercially exploit the Service or any part of it without our written permission.

We may suspend or terminate accounts that violate these rules, immediately and without prior notice if the violation is serious.

5. Your content

You retain all ownership of the content you create in the Service (group names, member names, expense descriptions, amounts, splits, settlements). By creating that content inside a shared group, you grant the other members of that group, and us as the service operator, a worldwide, royalty-free licence to host, store, transmit, display, and process it solely for the purpose of operating the Service.

You are solely responsible for the content you contribute and for choosing whom to invite into your groups.

6. Third-party sign-in

The Service offers optional sign-in via Apple or Google. When you use those options, you also agree to the terms of the relevant provider. We have no control over how those providers handle authentication and we are not responsible for outages or policy changes on their side.

7. No financial services

Dolio is a record-keeping tool. It does not move money between people, hold funds, process payments, issue invoices, give financial advice, or act as a bank, payment institution, or money-services business. Settlements you record in the app are bookkeeping entries only; the actual transfer of money happens outside the Service and is entirely between you and the people you track expenses with.

8. Service availability and changes

We aim to keep the Service running smoothly but we do not guarantee uninterrupted, error-free, or secure availability. We may modify, suspend, or discontinue any part of the Service at any time. Where a change materially reduces the functionality you rely on, we will give reasonable advance notice through the app or by email when possible.

9. Fees

The Service is currently provided free of charge. We reserve the right to introduce paid plans in the future; if we do, paid features will be clearly labelled and you will only be charged after expressly agreeing to the price.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of balance calculations, or that the Service will be uninterrupted, timely, secure, or error-free.

11. Limitation of liability

To the maximum extent permitted by law, in no event will CodeNomad be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses arising out of or in connection with your use of, or inability to use, the Service. Our total aggregate liability for direct damages arising out of these Terms or the Service is limited to fifty euros (€50). Nothing in these Terms limits liability that cannot be limited under applicable mandatory law (for example liability for gross negligence, intent, or death and personal injury).

12. Indemnity

You agree to indemnify and hold CodeNomad harmless from any claim, demand, or expense (including reasonable legal fees) brought by a third party arising out of your breach of these Terms, your misuse of the Service, or the content you contribute.

13. Termination

You may delete your account at any time from the in-app Profile → Delete account screen. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. The sections that by their nature should survive termination (including sections 5, 10, 11, 12, 15, and 16) will continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page and, for material changes, notify you in the app or by email. Continuing to use the Service after the new Terms take effect constitutes acceptance.

15. Governing law and forum

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Netherlands, without regard to its conflict-of- laws rules. The parties submit to the exclusive jurisdiction of the competent courts of the Netherlands, except that consumers retain the protection of any mandatory provisions of the law of their country of residence.

16. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
